The protection of your personal data is particularly important to us. We therefore process your data exclusively in accordance with legal provisions (DSG [Austrian data protection act], GDPR, TKG [Austrian telecommunications act] 2021) and have taken all necessary technical and organizational measures to ensure compliance with them.

With this Privacy Policy, we inform you about the most important aspects of data processing and provide an overview of which data we process and the purposes for which we process it.

Due to ongoing development of our website and the implementation of new technologies, it may become necessary to adapt this Privacy Policy. We will adapt minor changes to the data protection declaration, which you can access in the latest version on our homepage. We therefore recommend that you read this Privacy Policy again from time to time. If we undertake changes that have a significant impact on the processing of your data, we will inform you separately in advance.

2. Which data do we collect and for which purposes?

2.1. Data we obtain because of your visit on our website:

2.1.1. Logfiles

When you access our website, we collect and store the following access data (log files):

  • IP-address and IP-location
  • Referrer URL (the previously and subsequently visited website)
  • Number, duration, and time of visits
  • Search engines and keywords you used to look for our website
  • Browser type, device type, Internet service provider and operating system

 

The log files (access data) collected are used for the purpose of operation, security, creation of usage statistics and thus optimization of our website (predominantly legitimate interests).

2.2. Data that you provide to us:

If you contact us using the form on the website or by e-mail, the data you provide will be stored for the purpose of processing the inquiry and for any follow-up questions.

You are welcome to subscribe to our newsletter, the TPA Journal or any other TPA publication via our website. We process the data voluntarily provided by you for this purpose (salutation, academic title, name, company, email address, postal address) based on your consent.

You may revoke this consent at any time without affecting the lawfulness of the data processing carried out based on your consent until revocation by canceling your subscription to the newsletter, the TPA Journal or other TPA publications. Please send your revocation message

 

We will process your revocation as quickly as possible. Please note that there may be overlaps and you may still receive a publication after your have unsubscribed.

Once you have subscribed to the newsletter or a publication, we will send you a confirmation e-mail containing a link to confirm your subscription.

If you are in a contractual relationship with us, we would like to inform you that we need and process your data to fulfill our contractual obligations to you (e.g. payroll accounting, accounting, tax advice, tax returns, payment of invoices, fee payments) and to fulfill your legal obligations (e.g. calculation and payment of wage taxes). In addition, legitimate interests of our company also require the processing of your data (such as internal administration, use and training of AI Applications, documentation purposes or for the accounting and financial reporting of the TPA Group).

3. Transfer of personal data

To meet the above-mentioned purposes, it may be necessary to transfer your data to TPA Group Administration und Steuerberatung GmbH based in Vienna, to independent chartered accountants (= Cooperation partners of the TPA Group in Austria) and occasionally also to other service providers in the areas of IT, printing and mailing, each based in Austria or an EEA state. If, in exceptional cases, data is also transferred to an non-EEA country as part of the us of an IT service provider, we ensure that an adequate level of data protection is in place, in particular by concluding standard contractual clauses (2021/914/EC), which are available on request.

A restricted data set is also exchanged within theTPA Group, which acts as joint controller pursuant to Art 26 GDPR.

If you give us or have given us a cross-border order, we will transfer the necessary data to our subsidiaries and/or cooperation partners abroad. We will, of course, consult with you in advance if necessary.

Additionally, data is transmitted to authorities, courts, and public bodies in accordance with the respective legal obligations.

4. Cookies

Our website uses so-called cookies. Cookies are small text files that will be stored on your terminal device, using the browser. They do not cause any harm.

If you have given your consent, we use cookies to tailor contents and advertisements to your needs, to be able to provide functions for social media and to analyze access to our website. If you have not given your consent, we only use those cookies that are required to operate our website.

5. Additional information on the use of Google Analytics
(with anonymization function)

If you have given your consent, we also use Google Analytics on this website, a web analysis service of Google Ireland Limited, Gordon House Barrow Street, Dublin, 4 Ireland, hereinafter referred to as “Google”.

We use the IP anonymization option offered by Google. Your IP address is therefore anonymized by Google as soon as Google receives you IP address.

Google Analytics uses cookies to collect and analyze information regarding your use of our website (including your IP address and the URLs of the websites you visited), in order to generate reports on website activity for us. This information is usually transferred to a Google server in the USA or in other non-EU countries and stored there. We do not store any of your data collected in connection with Google Analytics.

You can also object to the setting of cookies via your browser settings or download an appropriate browser plugin from Google Analytics Opt-out Browser Add-on.

6. Storage period

We only store your personal data for as long as we need it to pursue the purposes described above and perform our contractual and legal obligations. In this context, it should be noted that for tax law reasons, data, contracts and other documents from an existing contractual relationship must generally be stored for a period of seven years (§ 132 BAO [Federal Fiscal Code]). In individual cases, for example in the case of pending official proceedings or due to other legal provisions, this storage period may also be longer than seven years. Under certain circumstances, a retention period of 30 years is legally stipulated. If we no longer need your personal data, we will delete it from our systems and records or anonymize it so that you can no longer be identified.

7. Your rights

We would like to inform you that you have at any time

  • the right to request information about which of your data is processed by us (Art 15 GDPR).
  • the right to revoke your consent to the processing of your data without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.
  • the right to have your data rectified (Art 16 GDPR).
  • the right to receive the data provided by you in a structured, commonly used and machine-readable format (“data portability” Art 20 GDPR).

 

We would also like to inform you that, if your data is no longer necessary for the purpose and/or fulfillment of the legal obligations for which it was collected, you have

  • the right to have your data erased (“right to be forgotten” Art 17 GDPR).
  • the right to restrict the processing of your data (Art 18 GDPR).

 

Furthermore, you have the right to object to data processing at any time if there are reasons for this arising from your particular situation (Art 21 GDPR).

If you believe that the processing of your personal data violates data protection law, you can file a complaint with the data protection authority (Barichgasse 40-42, 1030 Vienna; dsb@dsb.gv.at).
